“VIM Rewards” Terms and Conditions

1. Introduction

1.1 These Terms and Conditions ("Terms") govern the Vinomofo Loyalty Program ("Program"). They are designed to protect both the Members and Vinomofo. Members are responsible for reading and understanding these Terms.

1.2 These Terms are effective from the date specified above and may be amended by Vinomofo from time to time. The current Terms are available on the Vinomofo website. Members will be notified of material changes in accordance with clause 3.2.

1.3 These Terms form a contract between Vinomofo and each Member. Both Vinomofo and the Member are bound by these Terms.

2. Definitions

2.1 In these Terms, unless the context otherwise requires:

  • "Accepted Payment Method" means any form of payment accepted by Vinomofo for purchasing products or services.

  • "Points" refer to the loyalty points earned through the Program.

  • "VIM Rewards" refer to the benefits or status levels achieved by accumulating Points.

  • "Anniversary Date" refers to the date a Member created an account on the Vinomofo website.

  • "Status Credits" are credits earned by Members that allow them to progress through Membership tiers.

  • "Membership Cycle" is defined as starting on the customer's Anniversary Date and spans from that start date until the day before the same date in the following year. For example, if a customer's Anniversary Date is 1 April, their Membership Cycle will always span from 1 April to 31 March.

3. Membership

3.1 Membership is open to individuals aged 18 years and over. Membership is not available to companies, partnerships, or other entities.

3.2 Customers automatically become VIM Rewards members upon completing their first purchase with Vinomofo.

3.3 Each Member is permitted only one account. Membership is non-transferable.

3.4 Members are responsible for keeping their account information up to date, including contact details.

3.5 Birthday, Anniversary Credits and free shipping offers not redeemable within the Northern Territory

4. Earning Points

4.1 Points can be earned on eligible purchases made through the Vinomofo website. Vinomofo reserves the right to change points earning rates at any time and without notice.

4.2 Points have no monetary value and cannot be exchanged for cash, credits, or any cash substitutes. They are used solely to earn status or tiers of VIM Rewards.

4.3 Any points associated with a returned or partially refunded order that has been refunded to the original payment method will be subtracted from the customer's points balance.

4.4 For gift card purchases, status points will only be awarded when the credit is redeemed for a purchase. Points are not awarded upon purchase of the gift card itself.

4.5 The number of points that a customer earns on a transaction will be viewable on their order confirmation email and/or in their account details page.

4.6 When a customer makes a refund to credits with us, those points will remain on the account.

5. VIM Rewards and Membership Tiers

5.1 There are four Membership tiers in VIM Rewards: Green, Silver, Gold, and Platinum. The entry tier is Green, and Members may progress to higher tiers by earning Status Credits.

5.2 The number of Status Credits required to attain and retain Silver, Gold, and Platinum tiers are published on the Loyalty page. Retaining a tier requires fewer points than attaining a tier.

5.3 Membership tiers are valid for a minimum of one year. For example, if a Member has a Membership Cycle ending 31 December 2024 and qualifies for a higher Membership tier in June 2024, that Member will remain entitled to the applicable higher tier benefits until 31 December 2025.

5.4 If a customer does not meet the required amount of points to retain a tier within their Membership Cycle, they will be demoted at most by one tier.

5.5 A customer's status points will be reset to 0 at the start of each new Membership Cycle, regardless of your tier movements (i.e. tier promotions, tier retentions, or tier demotions).

5.6 Members will become eligible for Loyalty gifts after they have been a VIM Rewards Gold or higher member for at least one year. Vinomofo will communicate with eligible customers regarding this gift within their second VIM Rewards membership cycle. Members will only receive each of the gifts once at maximum. Platinum or Gold members who were Gold members in their previous membership cycle will be eligible for the Gold Loyalty Gift. Platinum members who were Platinum members in their previous membership cycle will be eligible for the Platinum Loyalty Gift.

5.6 Vinomofo reserves the right to change the benefits and gifts available at each tier at any time and without notice.

6. Special Offers and Vouchers

6.1 Where available, birthday vouchers will be sent to customers a week before their birthdays, and anniversary vouchers will be given two weeks before membership anniversaries. These credits will remain valid for 30 days and will be distributed either via email and/or via the customer's account page.

6.2 It is the responsibility of the member to note the validity and expiry dates of their vouchers. Expired vouchers will not be re-issued, and any remaining value on these vouchers will be forfeited.

6.3 Vouchers and credits can only be redeemed once and are for the use of the original account holder to whom they were issued.

6.4 When available, free Standard Shipping will be offered to eligible customers/tiers at the checkout page. This excludes Express Shipping.

7. Account Management

7.1 Members must notify Vinomofo immediately if they suspect any unauthorised use of their account.

7.2 Vinomofo is not responsible for any unauthorised access to a Member's account or any consequences thereof.

7.3 We reserve the right to terminate accounts or cancel Benefits and Rewards if abuse is detected.

8. Program Changes

8.1 Vinomofo reserves the right to modify or terminate the Program at any time. Members will be notified of significant changes in accordance with clause 3.2.

8.2 In the event of Program termination, Members will have a specified period to use their status benefits before they expire.

9. Data Privacy

9.1 Vinomofo is committed to protecting Members' privacy. Personal information will be handled in accordance with Vinomofo's Privacy Policy.

10. Liability

10.1 Vinomofo is not liable for any loss or damage arising from the Program, except as required by law.

10.2 Vinomofo's liability for any breach of these Terms is limited to re-crediting Points.

10.2.1 Vinomofo reserves the right to, acting reasonably, reverse or cancel any Points credited to a Member incorrectly, or not in accordance with, or in breach of, these Terms at any time.

11. General

11.1 These Terms are governed by the laws of the jurisdiction in which Vinomofo operates.

11.2 Any questions or disputes regarding the Program or these Terms should be directed to Vinomofo's customer service team.
